Gurugram SIT says attack on woman biker Shivani Chauhan was deliberate, chargesheet due within a week

A five-member special investigation team told Gurugram Police on 27 October that the 13 September crash on Golf Course Road was not an accident, and that helmet camera footage from the ride backs that up.

A case that every group of riders in India has been following closed one more loop this week. On 27 October, Gurugram Police said a five-member special investigation team had concluded that the 13 September crash involving Delhi rider Shivani Chauhan, who posts as Sia, was a deliberate act and not a road accident.

Chauhan, 27, from Kalkaji in Delhi, was riding with friends on Golf Course Road when a white Maruti Suzuki Ciaz followed the group. The occupants made obscene gestures, then the car rammed her motorcycle from the side and left the scene. She fell and slid along the road. Kalyan Bainsla and his cousin Lavnish were arrested on 15 September at Rajgarh in Dausa, Rajasthan. Both are in Bhondsi jail and their bail pleas have been rejected.

What the SIT concluded

The team was led by ACP (Crimes Against Women) Sushila and has submitted its report to the Police Commissioner. Bainsla had accepted that the collision was his fault but said he lost control near a U-turn and denied hitting the motorcycle on purpose. The SIT rejected that version and recorded the collision as intentional, following the misbehaviour on the road.

The sections in the FIR stay. Those are Section 78 of the Bharatiya Nyaya Sanhita for stalking, Section 79 for insulting the modesty of a woman, Section 109 for attempt to murder and Section 3(5) for common intention. "The charge sheet will be filed in court within a week, in accordance with the sections of law applied in the FIR," ACP Sushila told The Tribune.

The camera on the helmet did the heavy lifting

What separates this case from the hundreds of harassment incidents that die quietly is evidence. The chase and the impact were recorded on Chauhan's helmet mounted camera and on a camera carried by another rider in the group. That is the single most useful line in the whole file for anyone who rides in a group.

A helmet or tank mounted action camera now costs from about ₹8,000 for an entry level unit, and plenty of riders already carry one for ride edits. Treat it as safety kit instead. Keep the loop recording on, keep a spare card, and do not overwrite the card before you have pulled the clip off it. Two cameras in a group of four is better than one, because the second angle is what establishes a chase rather than a one off swerve.

Why Bengaluru riders should read the file

Bengaluru's women riders' groups and mixed clubs run the same patterns that put Chauhan's group on Golf Course Road that night, late rides back from a meet, four riders in loose formation, an unfamiliar car that will not pass. Clubs here can borrow three habits from this case at zero cost. Ride in a tight staggered formation after dark so a car cannot split the group. Agree a rule that nobody responds to gestures or shouting and the group pulls into a fuel station or a police outpost instead. Share live location with one person who is not on the ride.

The wider point is one that women's riding clubs in India have made for years. Mothers on Wheels, Bikerni Hyderabad, Nomad Bikers Club and SheMoto, all profiled in Deccan Chronicle on 8 October, exist partly because riding alone invites exactly this behaviour. The Gurugram chargesheet, when it is filed, will be the first big test of whether footage plus BNS stalking provisions can produce a conviction. Indian riders should watch what the court does with it.
