Does a local garage void your car warranty in India? What the CCI's order says, and what Hyundai and Maruti's own terms say

The Competition Commission of India told carmakers in 2014 not to impose a blanket warranty cancellation for using an independent repairer, but maker warranty terms still demand authorised servicing, and that gap is where owners get stuck.

The question that keeps coming back

The warranty question is one of the oldest running arguments in Indian car forums. A search of Team-BHP throws up at least six separate threads on it, including one titled "Authorised Service Centre or Independent Garage" that runs to 10 pages, plus threads asking what can make a warranty null and void, whether an owner can bring his own engine oil during the warranty period, whether a dashcam voids the warranty, and a motorcycle owner told by a dealer that his warranty would go if he skipped an oil change at 600 km. Those pages did not open for our fetcher, so we are going only by what the search listings show, and we are not quoting post counts or dates from them. The usual forum consensus in those listings is cautious: stay inside the authorised network while the car is under warranty.

On the complaint boards the dispute is sharper. One ConsumerComplaints.in entry we opened, filed in December 2014 against Maruti Suzuki and marked resolved in August 2020, involves a turbocharger shaft failure where the service centre's rejection letter blamed the owner's driving habit for poor oil circulation. Search listings on the same site show similar warranty rejection complaints against Force Motors and Bajaj Auto. The pattern is not local garages alone. It is owners being handed a reason for rejection they cannot test.

What the regulator actually ordered

There is an official answer, and it is 12 years old. In Case No. 03/2011, decided on 25 August 2014, the Competition Commission of India held that several carmakers invalidated warranties when a car was repaired by an independent repairer, treating it as an unfair condition under Section 4(2)(a)(i) of the Competition Act. The order text lists that finding against Honda and notes similar findings for Fiat, Ford, Mercedes-Benz, Mahindra, Nissan, Skoda and Tata.

A summary of the order records that the Commission imposed a penalty of 2 per cent of total turnover in India on 14 carmakers, directed them to let suppliers sell genuine spare parts in the open market, to put diagnostic tools and information in the public domain, and specifically "not to impose a blanket condition that warranties would be cancelled if the consumer avails services of any independent repairer". Safeguards on safety and liability were allowed. Compliance reports were due in 180 days.

What the makers' own terms still say

Read a current warranty policy and you will see why owners are confused. Hyundai Motor India's own warranty page states that to keep the basic warranty valid "the vehicle must be serviced by Hyundai Authorized Dealer or Service Centre", and excludes use of parts other than Hyundai genuine parts and accessories not supplied by the company. Its basic cover is 3 years with unlimited kilometres on models such as the Venue, Verna, Creta, Exter and Ioniq 5, and 3 years or 1,00,000 km on the Grand i10 Nios, Aura and i20.

Maruti Suzuki moved its standard warranty to 3 years or 1,00,000 km from 9 July 2024, with extended packages up to 4 years or 1,20,000 km, 5 years or 1,40,000 km and 6 years or 1,60,000 km, and says free repairs are available at its authorised service centres.

What an owner can do

Keep every job card and parts bill from an outside garage, with part numbers and the oil grade. If a claim is refused, ask the dealer for a written rejection that names the failed part and explains how the outside work caused that failure. A refusal that only says the car went to a local garage is exactly the blanket condition the CCI order targeted.

Escalate to the maker's customer care in writing first. If that fails, the National Consumer Helpline takes complaints on 1915 from 8 am to 8 pm in 17 languages, on WhatsApp at +918800001915, through its portal and the UMANG app, and lets you upload documents and track the grievance. Beyond that, a case can be filed with the district consumer commission through e-Daakhil.

What have you been told at your service centre about outside work? Tell us in the club thread.

If the CCI order is from 2014 and dealers are still writing "driving habit" as rejection reason, the order clearly has no teeth on paper. My Creta service book still says authorised network only. Anyone actually tried fighting a rejection with that CCI case number quoted to the dealer directly?

Same story on the EV side too, my 450X's warranty card also says authorised network only, no CCI number printed anywhere obviously. Irfan raises a fair point, on paper the order exists but nobody at the service desk is trained to even recognise that case number. Curious if two wheeler makers were ever named in that 2014 order or just the four wheeler lot.
