Can you buy a 10-year-old diesel car in Delhi NCR? What the Supreme Court order, the NOC and the PUC rules say
Forum buyers keep asking whether a cheap over-age NCR car is a bargain or a trap, and after the Supreme Court's December 2025 order the answer turns on the emission norm on the RC, not the year.

Audi A6Delhi-NCR cars are the cheapest used cars in India, and every month buyers in Lucknow, Jaipur, Indore and Bengaluru ask the same thing on the forums. A diesel past 10 years or a petrol past 15 years is being offered at a big discount by an NCR seller. Can you buy it, move it out and register it where you live?
Search results show at least six separate Team-BHP threads on exactly this, including one titled "Curious case of Delhi-NCR used cars", one on what to do with a 10-year-old Audi A6 in NCR, and one on transferring an NCR-registered Volvo XC60 diesel to another state. Those forum pages would not open for me, so I am not quoting or counting posts in them. What follows is the official position.
Two sets of rules apply to the same car
Under the Motor Vehicles Act, 1988, a private car gets 15 years of registration and then renewals in blocks of five years as long as it passes a fitness test, with no fixed scrapping age. In Delhi-NCR, a separate age rule sits on top: following NGT orders and the Supreme Court's approval in M.C. Mehta, diesels over 10 years and petrols over 15 years are barred regardless of condition. That dual regime is set out in an analysis by SCC Online, which also records the Delhi government's Guidelines for Handling End of Life Vehicles in Public Places of Delhi, 2024, dated 20 February 2024. The guidelines are listed on the Delhi Transport Department's own site.

The position has moved twice since. SCC Online records a Supreme Court order of 12 August 2025 directing that no coercive steps be taken against over-age vehicles, and an order of 17 December 2025 that narrowed the protection to BS-IV and newer vehicles. Autocar India reported the same December 2025 order as reinstating the ban on BS-III and older vehicles in Delhi-NCR, with BS-IV and above unaffected. So the first question to ask a seller is not the car's age. It is the emission norm on the RC.
The NOC and the PUC are where buyers get stuck
To take the car out, the seller needs a No Objection Certificate. MParivahan's official page says the application is made under Section 48 in Form 28 to the registering authority where the vehicle was last registered, with certified copies of the RC and insurance, proof of tax paid, a PUC certificate and pencil prints of the chassis and engine numbers, and the fee specified in Rule 81 of the Central Motor Vehicles Rules, 1989.
Until recently NCR sellers had a 12-month window. The Tribune reported that on 31 October 2025 the Delhi government removed the one-year limit, so owners of deregistered diesels past 10 years and petrols past 15 years can apply for an NOC whenever they want, if the destination state will take the vehicle.
The live problem is the PUC. ThePrint reported in August 2026 that pollution testing software still auto-rejects certificates for vehicles past the age thresholds even when they pass the emission test, and that a Delhi owner of a 2016 BS-IV Volvo has gone to the Supreme Court over it. No PUC means no NOC paperwork, and CAQM's fuel-denial direction, suspended in October 2025, had earlier been scheduled for 1 July 2025 in Delhi, 1 November 2025 in five districts and 1 April 2026 in the rest of NCR.
- 1 July 2025Fuel denial was to start in Delhi
- 1 November 2025Fuel denial was to start in five high vehicle density districts
- October 2025A CAQM notification suspended the directive to comply with Supreme Court modifications
- 1 April 2026Fuel denial was to start in the rest of NCR

What to do before you pay
Read the RC and check the emission norm, not just the year. Ask the seller to show you the Form 28 NOC in hand, not a promise. Confirm with the RTO you will register in that it accepts an NCR-deregistered vehicle, and ask what road tax you will pay again. If a dealer takes your money and the NOC never comes, escalate to the dealer in writing, then the state transport department, then the National Consumer Helpline on 1915.
